Charged with DUI in Virginia?

In the state of Virginia, you are considered to be driving under the influence if you are operating a motor vehicle with a blood alcohol concentration of .08% or higher. For those under the age of 21, the BAC threshold drops to .02%. In general, if you ingested substances that impair your ability to operate a vehicle safely, you are at risk of being charged with driving under the influence.

Virginia operates under implied consent laws. This means that, if you are lawfully arrested for a DUI, you are required to submit to a blood or breath test. If you refuse, you may face a license suspension of up to three years.

Penalties You May Face If Convicted of Driving Under the Influence

A DUI can carry life-altering penalties depending on whether or not you have been previously charged with driving under the influence.

For first-time offenders, you may be facing up to 12 months in jail, a fine of up to $2,500 but not less than $250, a one-year license suspension, and a requirement to install an ignition interlock device in your vehicle.

If this is your second DUI offense, you may be dealt a jail sentence of up to 12 months and not less than 10 days, a fine of up to $2,500 but not less than $500, a three-year license suspension, and a requirement to install an ignition interlock device in your vehicle.

Those facing a third DUI offense will have to spend up to five years but no less than 90 days in jail, pay a maximum fine of $2,500 or a minimum fine of $1,000, deal with an indefinite license suspension, and install an ignition interlock device.
